Terms of Service Effective Date: August 2024 1. Introduction Welcome to The Beans Club (the "Platform"). By accessing or using our Platform, you agree to comply with and be bound by these Terms of Service ("Terms"). Please read these Terms carefully before using the Platform. 2. Eligibility To use the Platform, you must be at least 18 years old or have the consent of a parent or guardian. By using the Platform, you represent and warrant that you meet these eligibility requirements. 3. Subscriptions and Payment - Subscription Services: Our Platform offers online yoga and movement classes on a subscription basis. By subscribing, you gain access to our content and services for the duration of your subscription period. - Payment: Subscription fees are charged in advance on a [monthly/annual] basis. Prohibited activities include, but are not limited to: - Posting or transmitting any harmful, abusive, or unlawful content. - Attempting to gain unauthorized access to the Platform or other user accounts. - Engaging in any activity that disrupts the operation of the Platform. 6. Intellectual Property All content, materials, and features available on the Platform, including text, graphics, logos, videos, and software, are the property of The Beans Club or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or use any content from the Platform without our express written permission. 7. Disclaimer of Warranties The Platform is provided "as is" and "as available," without any warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Platform will be uninterrupted, error-free, or secure. 8. Limitation of Liability To the maximum extent permitted by law, The Beans Club and its affiliates shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of the Platform, even if advised of the possibility of such damages. 9. Governing Law These Terms shall be governed by and construed in accordance with the laws of the province of Ontario and the federal laws of Canada applicable therein, without regard to its conflict of law provisions. 11.
